Data protection and hosting for projects in Saudi Arabia

Where the data lives is one of the first real decisions on any Saudi project, and it is where most vendor advice is wrong. Saudi law does not require private-sector data to be hosted inside the Kingdom. The Personal Data Protection Law contains no residency provision, and the National Cybersecurity Authority removed its hosting mandates in 2024.

What the Law does impose is an adequacy-and-minimisation test on transfers abroad: the transfer must not prejudice national security or the Kingdom's vital interests, there must be an adequate level of protection no less than the Law provides, and it must be limited to the minimum data needed. The Law also reaches processing carried out outside the Kingdom relating to people residing in it, so hosting abroad does not put a project outside its scope.

Health data is treated separately and more strictly — it is named within Sensitive Data, and unlawful disclosure carries up to two years imprisonment, a fine of up to three million riyals, or both. We scope hosting against what your tender actually requires rather than against a rule that does not exist.
